California doctor gets probation for overprescribing drugs

An Oxnard, California doctor has admitted he overprescribed pain medication to some of his patients, and the Medical Board of California has placed him on seven years' probation and suspended him for nine months.
Dr. Michael Huff settled his case with the board Tuesday, less than a week before his hearing was set to begin. As part of the agreement, he admitted wrongdoing in his treatment of six patients between 1997 and February 2003.

Specifically, Huff admitted he overprescribed various addictive painkillers -- mostly OxyContin, a drug compared by some experts to heroin because of its powerful effect -- to patients who either had a history of opiate abuse or who eventually overdosed or went into detox and were hospitalized, according to the settlement.

Huff could not be reached for comment, and his attorney, Peter Bertling, did not return phone calls.

The Ventura County, California Sheriff's Department still is investigating Huff on suspicion of overprescribing painkillers to addicts and other patients, three of whom died of overdoses. Investigators also believe Huff prescribed drugs to people who then sold the pills on the street, according to court documents.

He has not been arrested nor charged with a crime, and authorities have given no timetable for possible criminal action.

As part of the settlement, Huff cannot practice medicine for nine months, cannot prescribe any drugs during that period and is barred from practicing any form of pain management for the entire seven-year probation.

He must take a bevy of refresher courses to reacquaint himself with medical ethics, and when he begins practicing again, another doctor must monitor him for the first five years of his probation.

Huff also was ordered to pay $30,000 for investigative costs and about $20,000 for probation expenses.

The board originally charged him with 18 "causes for discipline," and he admitted to six of them. They included the following cases:


D.D., 50, who saw Huff for a back injury in 2001. He prescribed her 1,000 milligrams of OxyContin and 2,510 mg of Soma per day, plus other drugs. She ended up in detox.
B.B., 20, a chronic heroin user who had track marks on her arm when she saw Huff for neck and back pain. After taking 2,700 mg per day of OxyContin he prescribed her, she landed in detox.
I.L., 37, received excessive amounts of OxyContin from Huff for shoulder and arm pain.
J.L., 50, suffered from extreme back pain. Huff overprescribed OxyContin, and she was hospitalized. Huff then announced he no longer would accept certain insurance plans. J.L. later was hospitalized for withdrawal symptoms.
C.L., 26, had back pain. Huff gave her Methadone, Hydrocodone and 3,300 mg of OxyContin per day. He later gave her a drug test to see if she was taking the medication, which showed she was not, but also showed she was using cocaine. Huff continued to prescribe the drugs.
D.O., 40, had a history of alcohol and drug abuse when she met Huff at a friend's house. When he asked her if she was in pain, she said she had pain in her neck and bones. Without conducting a physical exam, Huff wrote her a prescription for 50 Vicodin pills on the spot.
